Whether your backyard pavilion needs a building permit in the Kansas City metro depends on which city or county issues permits for your lot and how big the pavilion is. Kansas City, Missouri, Jackson County, Overland Park, Olathe and unincorporated Johnson County exempt detached accessory structures under 200 square feet; Lee's Summit, Parkville, Lenexa and Shawnee draw the line at 120 square feet; Liberty, Clay County and Platte County publish no exemption. Zoning setbacks and height limits apply in every one of them whether or not a permit is required, and electrical work is its own permit. We build in all of these jurisdictions and handle the drawings and submissions; this page is the table we work from, read directly from each code on September 30, 2026.
How to use this page
Find your permitting jurisdiction, not your mailing city. An Overland Park address can sit in unincorporated Johnson County; Northland addresses split between Kansas City, Missouri, Gladstone, Liberty and unincorporated Clay County. Your county's parcel viewer or your property tax statement names the jurisdiction. Then read three layers, because all three apply:
- Building permit — triggered by size (the threshold column), and by electrical work regardless of size.
- Zoning — setbacks, height, footprint and lot-coverage caps, easements. Applies even when the building permit is not required.
- HOA / architectural review — private, additional, and usually first. No city checks it for you.

Patterns worth knowing
Two threshold camps. 200 square feet (Kansas City, MO; Jackson County; Overland Park; Olathe; Johnson County) versus 120 square feet (Lee's Summit; Parkville; Lenexa; Shawnee). A 12×16 pavilion is 192 square feet — exempt in the first camp, permitted in the second. A 14×16 (224) or anything larger is permitted everywhere that publishes a threshold.
Gazebos and pergolas are named in the rules. Overland Park lists gazebos among the structures exempt at 200 square feet or less, and its open-pergola exemption requires a top that is at least 50 percent open with no member wider than 2 inches — a solid roof fails that test at any size over 200. Olathe lists pergolas and gazebos as accessory-structure permit types; Lenexa defines gazebos as accessory buildings. No jurisdiction we read gives an open-sided roofed structure a break that a shed does not get.
Kansas City, Missouri caps height at 10 feet. Code section 88-305 limits accessory buildings and structures to 10 feet (garages 16) and limits an individual detached accessory building to a 200-square-foot footprint, with a Board of Zoning Adjustment variance beyond that. A typical pavilion with 8-foot posts and a pitched roof exceeds 10 feet. We plan KCMO pavilions around this from the first meeting; see the Kansas City, MO page.
Shawnee allows one accessory building per lot. If you already have a shed, ask before designing.
Easements are off limits. Olathe: accessory structures "shall not encroach on a drainage or utility easement." Shawnee: small structures must be "outside any utility easements." Lenexa requires easements on the plot plan. Pull the plat.
Footings: 36 inches, with three different reliefs. Every jurisdiction that publishes a frost line uses 36 inches. Lenexa waives frost-depth footings for detached accessory buildings of 600 square feet or less. Shawnee requires the 36-inch bottom only above 400 square feet. A Johnson County foundation guideline allows 12-inch-deep footings for freestanding accessory structures of 600 square feet or less with eaves no higher than 10 feet — the document cites an older code edition, so we confirm it with each Johnson County city before relying on it. Code editions are moving. Lee's Summit adopts the 2024 IRC and 2023 NEC for permits filed on or after October 1, 2026. Parkville adopted the 2024 codes in January 2026. Shawnee runs the 2024 IBC and 2023 NEC with the 2018 IRC. Clay County is still on the 2012 IRC.
Who can pull the permit. Overland Park: an owner-occupant may act as contractor for their own home, but every subcontractor needs a Johnson County contractor's license. Lee's Summit: homeowners may permit work on their primary residence; contractors hold Class A–D licenses with $300,000 in liability coverage. Jackson County: owner-occupants sign an affidavit of one-year occupancy. Olathe: homeowners file a homeowner affidavit. Kansas City, Missouri: contractors need a city business license and a residential contractor license. Johnson County's Class A, B and C licenses all cover residential accessory buildings; electrical work needs a Class DE contractor.
Electrical is a separate permit
Fans, lights and outlets in a pavilion are an electrical permit in every city, even when the structure itself is exempt. Overland Park requires a permit for "installation or replacement of any building wiring or equipment, including branch circuits." Johnson County requires a licensed electrical contractor (Class DE) for the trade work. Whether a homeowner may wire their own pavilion varies and was not published by any city we read — ask before you plan to.
HOA and architectural review
No city page mentions your HOA, because it is not the city's business. Most Johnson County subdivisions, and much of Lee's Summit and the Northland, have an architectural review committee that must approve a pavilion before you build — usually before the city permit. The packet is nearly always the same items the cities ask for: a site plan showing the pavilion and property lines, elevations, and materials and colors. We provide those drawings and specs.

Frequently asked questions
My pavilion is under the threshold. Do I still need anything? Zoning setbacks and height caps apply regardless; an electrical permit if you wire it; and your HOA's approval.
Does "exempt" mean I can skip footings? No. Exempt means the city will not inspect it. A pavilion still needs footings that keep it standing in a 115-mph design wind and a Kansas City freeze-thaw cycle.
Do kits count? Yes. A boxed cedar kit anchored to a slab is an accessory structure at every city hall in the metro.
What if my lot straddles two jurisdictions or my HOA says one thing and the city another? Both apply; the stricter one wins in practice. Bring both sets of rules to the design meeting and we will size the pavilion to satisfy both.
